By accessing or using Simyl Flow, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Simyl Flow is a retrospective management platform that helps software engineering teams conduct data-driven sprint retrospectives. The Service integrates with third-party project management and source control tools to provide metrics, insights, and AI-generated analysis.

To use certain features of the Service, you must create an account.

• –Notify us immediately of any unauthorized use
• –Ensure your account information is accurate and current

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

You agree not to use the Service to:

• –Infringe on intellectual property rights of others
• –Transmit malicious code or viruses
• –Attempt unauthorized access to the Service
• –Harass, abuse, or harm others
• –Share account credentials with third parties
• –Use automated systems to extract data without permission

The Service integrates with third-party tools including Jira, Linear, GitHub, and Bitbucket. Your use of these integrations is subject to their respective terms of service.

By connecting integrations, you grant us permission to access data necessary to provide the Service. We only access data required for features you use.

Simyl Flow offers both free and paid subscription plans. By subscribing to a paid plan:

• –Pay all fees according to the pricing displayed at purchase
• –Provide accurate billing information and keep it current
• –Accept automatic renewal unless you cancel before renewal date

Subscription fees are non-refundable except as required by law or explicitly stated in these Terms.

We may offer a free trial period for new users. At the end of the trial, you will be automatically converted to the Free plan unless you upgrade. No credit card is required to start a free trial.

The Service and its original content, features, and functionality are owned by Simyl and protected by international copyright, trademark, and intellectual property laws. You retain ownership of content you submit.

By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for providing the Service and as described in the Aggregate & Anonymized Data section below.

We may use anonymized, aggregated data derived from your use of the Service to improve the Service, develop new features, conduct research, and publish industry insights.

• –Aggregated data is combined from multiple users and teams such that no individual, team, or organization can be identified
• –No customer content, source code, or proprietary text is used in publications — only aggregated metrics
• –We will never attribute specific data to you, your team, or your organization in any publication or report

The Service uses artificial intelligence to generate insights, summaries, and recommendations. AI-generated content is provided for informational purposes only and should not be relied upon as professional advice.

We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

To the maximum extent permitted by law, Simyl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Our total liability for any claims shall not exceed the amount you paid us in the twelve months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

We may terminate or suspend your access immediately, without prior notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of termination.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting new Terms and updating the "Last updated" date. Continued use constitutes acceptance.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
